Ohio follows a modified comparative negligence statute. This means that you can still recover damages even if you share some responsibility for the crash, but only if you are less than 51% at fault. Your compensation will then be reduced by your percentage of fault.

For instance, if your total damages are $400,000 but you’re found 25% at fault, you could still receive $300,000.

Should I Still Buy MedPay if I Have Health Insurance?

Yes, many drivers find MedPay worthwhile even if they already have health insurance. MedPay can:

  • Cover deductibles and co-pays that your health insurance doesn’t pay
  • Apply to passengers who might not have insurance of their own
  • Provide coverage for immediate medical costs before your health insurer processes claims

Having MedPay can prevent financial strain in the days following an accident in many circumstances, such as if your injuries require emergency care and ambulance transport.

Can I Still File a Lawsuit if I Use MedPay?

Yes. Using MedPay does not prevent you from pursuing additional compensation through a personal injury claim. MedPay simply covers some of your initial expenses.
